TERMS AND CONDITIONS OF SALE
I. TEACHING AND SUPERVISION SERVICES
Registration for ACTIVALPINE services implies full acceptance of these terms and conditions by the subscriber, who undertakes to inform each participant of all terms and conditions.
ART. 1 – PARTICIPANTS
ACTIVALPINE offers, on its own behalf, on behalf of authorized companies and on behalf of independent instructors, the supervision and teaching of so-called risk sports and outdoor activities: skiing, snowboarding, free-ride, freestyle, ski touring, heliskiing, kayaking, inflatable kayaking, canoe-raft, kite surfing, rafting, white-water swimming. All the activities on offer are supervised by trained ski instructors or guides who are qualified in their respective disciplines and meet their legal obligations.
ART. 2 – REGISTRATION AND RESERVATION
All our activities must be booked in advance. There are several ways of doing this: by filling in the online request form or by contacting ACTIVALPINE directly by e-mail via the online contact form, by telephone on +41 79 855 45 45 or by booking online.
The balance of the booking must be paid directly to ACTIVALPINE at the start of the activity.
ART. 3 – PRICES
ACTIVALPINE prices are shown on the website and in the activity catalog available at reception.
Prices include: organization, supervision by a qualified ski or snowboard instructor or guide, and the loan of technical and safety equipment required for the chosen activity (wetsuit and neoprene jacket, neoprene booties, helmet, harness, life jacket, etc.).
Equipment rental is available on special request by e-mail or telephone.
In all cases, please refer to the product data sheet, available on our website or on request.
Activity prices do not include: transport to the meeting point or personal expenses.
For full-day snowsports lessons, it’s customary for the client to invite the instructor to dine at his table. Please let us know if you need an exemption.
For day trips, meals (picnic, water, snacks) are at the customer’s expense, unless otherwise stated.
ART. 4 – METHOD OF PAYMENT
For supervision services, payment must be made directly to the instructor providing the session, to the attention of ACTIVALPINE. In the case of subcontracting with a company or self-employed person, the remaining payment will be made directly to the service provider carrying out the activity.
Means of payment accepted: Bank transfer, credit card (secure payment by internet or on site with TPE) or cash.
ART. 5 – CONDITIONS OF PARTICIPATION
Our activities are open to all; however, depending on the activity and the itinerary, certain conditions must be taken into account (age limit, specific off-piste equipment, ability to swim, technical level, physical condition, etc.).
ACTIVALPINE does not have the means to check the level of sporting experience of its customers.
It is therefore up to each participant to assess his or her physical condition according to the choice of itinerary he or she wishes to follow. To find out about these conditions, please refer to the course technical information (available on our website www.activalpine.com).
In addition, for whitewater activities, it is necessary to read, sign and submit the participation form before the start of the activity.
For canyoning and whitewater activities, you need to be able to swim 25m and immerse yourself.
You must not have any medical contraindications to the chosen activity.
IMPORTANT: If you have no medical contraindications, but are dependent on special medical care or treatment (asthma, diabetes, etc.), or if your state of health requires special attention (fragile joints, back problems, compulsory wearing of glasses, etc.), you must inform the instructor before the start of the activity and bring the appropriate emergency medication, as recommended by your doctor.
ART. 6 – INSURANCE AND LIABILITY
Each instructor/professional is covered by Professional Civil Liability insurance for activities within ACTIVALPINE or for his own activities (subcontracting), as well as for costs incurred in the event of a rescue operation.
We strongly advise all participants to take out civil liability and/or personal accident insurance with the insurance company of their choice for whitewater and/or mountain sports. In fact, we cannot replace the individual civil liability of each participant.
ACTIVALPINE is insured against civil liability for all the activities it offers and cannot be held responsible for activities booked or carried out with other service providers.
In the event of bodily injury, ACTIVALPINE and the instructor are not liable until the victim has been taken care of by the appropriate emergency services, and any subsequent hospitalization is the responsibility of the injured party’s personal insurance.
The practice of outdoor activities takes place in a specific environment known as “at risk”.
Given the specific nature of the activities on offer, each participant is aware that he or she may run certain risks due to remoteness, isolation and the specific nature of the environment (piste, off-piste, sea, river, cave, cliff, etc.). He/she assumes these risks with full knowledge of the facts, and must comply with the rules of caution and follow the advice given by the professionals.
The participant/client is responsible for the equipment loaned to him/her for the activity. The professional cannot be held responsible for any damage caused by the equipment made available.
In the event of theft or damage to the equipment loaned, the participant/customer may be asked to pay compensation for wear and tear or a full refund of the equipment.
The professionals (instructors) and ACTIVALPINE cannot be held responsible for the loss, theft (including from vehicles) or breakage of objects (e.g. glasses, cameras, etc.) that participants may take with them during the activity and that may occur during the activity.
ART. 7 – CANCELLATION / INTERRUPTION BY THE CUSTOMER
7.1 Cancellation by the customer
– Cancellation of a booking more than 30 days in advance: full refund of the deposit
– Cancellation of a booking less than 15 days in advance: the deposit is retained
– Cancellation of a booking less than 3 days in advance: the balance will be retained or demanded
In the event of force majeure and on presentation of proof, ACTIVALPINE may refund the sum paid, but may not be demanded by the customer. In all cases, the customer undertakes to notify ACTIVALPINE of any notifications relating to the booking: organization of the program, changes in the number of people, delays or cancellations.
If the ski lifts are closed due to bad weather or any other reason, the booking will be moved subject to availability; if this is not possible, a credit note will be issued.
For online bookings, refunds are only possible in the event of cancellation by ACTIVALPINE.
7.2 – Interruption during service
In the event of interruption of the service, the customer or participant will not be entitled to any reimbursement.
ART. 8 – CANCELLATION / EXCLUSION BY ACTIVALPINE
8.1 – Cancellation
ACTIVALPINE’s instructors reserve the right to cancel or adapt the outing according to weather conditions or the level of participants.
The activity may be cancelled for safety reasons (weather, dam water releases, floods, etc.) or for any other case of force majeure. In this case, a replacement activity will be organized if possible, or you will be offered another date. If the outing cannot take place, the service will be reimbursed in full, without entitlement to any further compensation.
In the event of cancellation by us due to insufficient numbers of participants (less than 3), participants will be reimbursed in full and will not be entitled to any compensation.
If the instructor is late (more than 15 minutes) for no valid reason (accident, illness, official disruption to traffic or lifts), the lesson is either made up at the customer’s discretion, refunded at the rate of 30%, or reimbursed in full in the form of a voucher or bank transfer.
8.2 – Exclusion
ACTIVALPINE instructors reserve the right to exclude any participant who is intoxicated or whose behavior is likely to disrupt the activity or compromise the safety of the group. In this case, the customer or participant will not be entitled to any refund or compensation.
ART. 9 – APPOINTMENTS
An appointment time and place is systematically communicated to you, whatever the service, once payment has been received. For the smooth running of the activities and out of respect for the other participants and the professional who is supervising you, we kindly ask you to take note of the roadmaps and other instructions sent to you by us beforehand. Make sure you plan your journeys in advance, so as to be punctual, and fill in the required forms before you arrive. For summer activities, we tolerate a maximum delay of 15 minutes. After this time, the instructors leave for their activities and no refund or compensation will be due. For winter activities, if the student is late, the instructor will wait until 30 minutes after the scheduled start of the lesson. Sliding catch-up is at the instructor’s discretion and availability.
ART. 10 – SUPERVISION OF MINORS
Eau-vive: unaccompanied minors:
Minors under 14 unaccompanied by an adult (legal guardian) are not accepted on activities.
Unaccompanied minors aged between 14 and 18 can take part in activities, subject to parental authorization and certain conditions (sporting level, ability, etc.)
In this case, a parental authorization form must be signed by the legal representative on the day of the activity.
Minors on CVL / CLSH / School trips:
The organization organizing the trip or outing must be able to provide ACTIVALPINE and the instructor with the following for each participant (youth and instructor)
– the form attesting to the ability to swim 25m and to immerse, provided by ACTIVALPINE for each participant.
In addition, ACTIVALPINE undertakes to provide, on request, the certificates and documents necessary for the organization of the trip/outing (insurance, supervisors’ qualifications, etc.).
Supervision of minors with ACTIVALPINE is limited to 14 young people and 2 supervisors (maximum) per raft and 7 young people plus 1 supervisor for canyoning and hydrospeed. Each group of minors must be accompanied by at least 2 adults, including a center counselor and the activity leader.
ART 11. GIFT VOUCHER
The gift voucher becomes effective on receipt of the full amount of the service.
The order form is nominative. However, it may be transferred to a person of your choice, provided that you notify us in advance to change the details of the new beneficiary.
The beneficiary of the gift voucher must contact us to book the outing.
The activity on the gift voucher may be replaced by another activity offered by ACTIVALPINE, provided that the value of the latter is less than or equal to the activity mentioned on the gift voucher. However, it is possible to take part in a higher-value activity and pay the difference.
ATTENTION: The gift voucher has an expiration date. Once the validity period (365 days from the date of issue) has expired, the service will be deemed to have been performed and cannot be postponed. The beneficiary and/or purchaser will not be entitled to any reimbursement or compensation.
The gift voucher and personal document must be presented to the instructor in charge of the session on the day of the outing.
The outing will be guaranteed if the minimum number of participants required is ensured and if the weather conditions allow the activity to be carried out correctly.
ART. 12 – SETTLEMENT OF DISPUTES
The parties shall endeavor to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and execution of the present agreement will be governed exclusively by the rules of SWISS law.
All disputes, of whatever nature, will fall within the jurisdiction of the Swiss civil and commercial courts. The place of jurisdiction is Sierre.
II. EQUIPMENT RENTAL
ART
1. RESERVATION
All our activities, including equipment hire, are booked in advance. There are several ways of doing this: by filling in the online offer request or contact form, or by contacting ACTIVALPINE directly by e-mail (info@activalpine.com), by telephone (+41 79 385 89 47) or by booking directly online.
The booking is effective from the moment the subscriber receives an e-mail or SMS message confirming the booking.
ART. 2 – PRICES
Rental prices are posted on the website in the ACTIVALPINE C G Vs.
– In whitewater, prices include: rental of technical equipment.
Below are the different rental formulas:
Raft rental kit: paddle for the number of places in the raft, raft, pump. 250/day or 150/half-day.
White-water equipment rental kit: wetsuit, neoprene jacket and booties, lifejacket, helmet. CHF 50/day or CHF 35/half-day.
Canyoning rental kit: harness with lanyards and descender, white-water rental kit, helmet. 80./chf/day or 50./chf/half-day.
– In snow sports, prices include only the service, with the exception of snowkiting.
ART. 3 – METHOD OF PAYMENT
Payment should be made payable to ACTIVALPINE.
Payment methods accepted: bank transfer, credit card (TPE) or cash.
For live-water equipment, a cash deposit of CHF 200.00 is required for each item of equipment rented, and will be returned when the equipment is returned. The balance must be paid when the equipment is returned.
Opening hours are specified when the equipment is handed over. In the event of late return (outside opening hours), a surcharge of 20.-chf will be payable.
ART 4. INSURANCE AND LIABILITY
In the case of sports activities with equipment, and especially in the case of sports equipment rental (excluding activities supervised by an instructor), the customer acknowledges that he/she has sufficient knowledge and technical skills to carry out the sports activity alone. In this case, the customer takes full responsibility for the activity for which the equipment is hired, and does so at his or her own risk. ACTIVALPINE cannot be held responsible for any accidents that may occur during these activities.
As the team and ACTIVALPINE do not have the means to check the level of sporting experience of their customers, it is up to each participant/customer to assess their physical fitness, knowledge and skills in relation to what they wish to achieve.
ART. 5 – INSURANCE
ACTIVALPINE is insured for Professional Civil Liability for its own activities, and cannot be held responsible for any incident or accident that may occur during an unsupervised activity.
In addition, we strongly advise all participants to take out third-party liability and/or personal accident insurance with the insurance company of their choice for mountain sports.
The practice of outdoor activities takes place in a specific environment known as “at risk”.
Given the specific nature of the activities involved, each participant is aware that he or she may run certain risks due to remoteness, isolation and the specific nature of the activity and environment (river, cave, etc.). He/she assumes them with full knowledge of the facts and must comply with the rules of caution and follow the recommendations of federations, associations and competent authorities.
The participant/customer is responsible for the equipment allocated to him/her. ACTIVALPINE cannot be held responsible for any damage caused by this material. In the event of theft, loss or damage to rented equipment, the participant/customer will be asked for compensation for wear and tear or a full refund of the equipment.
ACTIVALPINE cannot be held responsible for the loss, theft (including from vehicles) or breakage of objects (e.g. glasses, cameras, etc.) that participants may take with them during the activity and that may occur during the activity.
ART. 6 – CANCELLATION / INTERRUPTION BY THE CUSTOMER
6.1 Cancellation by the customer
In the event that the customer has paid a deposit, the following refund clauses apply:
– Cancellation of a reservation more than or at least 30 days in advance: full refund of the deposit
– Cancellation of a reservation more than or at least 15 days in advance: the deposit is retained
– Cancellation of a reservation less than 3 days in advance: the balance will be demanded
6.2 Cancellation by ACTIVALPINE
ACTIVALPINE reserves the right to cancel an activity for safety reasons (weather, course maintenance, flooding, etc.) or any other case of force majeure. In this case, another date/slot will be proposed to the customer, if possible. If the outing cannot take place, the amount paid will be reimbursed in full, without entitlement to any other compensation.
6.3 Exclusion / refusal to rent equipment
ACTIVALPINE reserves the right to refuse equipment rental to a participant whose level of competence does not allow him/her to practice the activity safely alone, or whose behavior is such as to compromise his/her own safety and that of the group accompanying him/her. In this case, the customer or participant will not be entitled to any refund or compensation.
ART. 7 – YOUNG PEOPLE (MINORS)
Unaccompanied minors: Minors under 18 not accompanied by an adult (legal guardian) are not allowed to rent technical equipment.
ART. 8 – SETTLEMENT OF DISPUTES
The parties shall endeavor to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and performance of the present agreement will be governed exclusively by the rules of Swiss law.
All disputes of any nature whatsoever will be subject to the jurisdiction of the Swiss civil and commercial courts.
